End User License Agreement
Effective Date: 10 September 2024
Meta Healthcare is licensed to You (End-User) by Meta Healthcare Pty Ltd, located at 29 Melissa Street, Upper Coomera, QLD 4209, Australia (“Licensor”), for use only under the terms of this License Agreement. By downloading the Licensed Application from Apple’s App Store and Google’s Play Store, and any updates thereto, You agree to be bound by all the terms of this License Agreement.
The parties acknowledge that the Services (App Store and Play Store) are not a party to this License Agreement and are not bound by its terms. Meta Healthcare Pty Ltd, not the Services, is solely responsible for the Licensed Application and its content. This License Agreement complies with the Usage Rules of the App Store and Play Store. Meta Healthcare Pty Ltd confirms that this License Agreement is in alignment with the latest Apple Media Services Terms and Conditions and Google Play Terms of Service (“Usage Rules”). The application is to be used on devices operating with Apple’s iOS or Google’s Android operating systems.

Privacy Policy
1.1. The App is designed to facilitate healthcare services such as scheduling appointments and engaging with healthcare providers.
1.2 Not an emergency service: The App is not designed for use in emergency situations. If you are experiencing a health emergency, please call 000 immediately.
1.2. You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement.
1.3. You agree to use the App solely for its intended purposes and in compliance with all applicable laws and regulations.
2.1. Meta Healthcare grants you a non-exclusive, non-transferable license to install and use the App on your personal devices in accordance with these Terms.
2.2. This license is subject to your compliance with the Usage Rules of the relevant platform (App Store or Play Store).
2.3. You agree not to reverse-engineer, modify, distribute, or resell any part of the App without prior written consent from Meta Healthcare Pty Ltd.
2.4. The App is designed for use on iOS and Android operating systems. You are responsible for ensuring that your device meets the necessary technical requirements.
3.1. The App provides information intended to assist you in making healthcare decisions but is not a substitute for professional medical advice. Always seek the advice of a healthcare professional for medical conditions or concerns.
3.2. Meta Healthcare does not guarantee that the information provided through the App is accurate, complete, or up-to-date, and we disclaim all liability for decisions made based on the information accessed through the App.
4.1. We are committed to protecting your privacy. All personal data collected through the App is processed in accordance with our Privacy Policy (see below), which is incorporated into these Terms by reference.
4.2. While we take reasonable steps to protect your personal data, you acknowledge and accept the inherent risks associated with transmitting personal information over the internet.
4.3. In the event of a data breach that compromises your personal information, we will take prompt action, including notifying you as required by applicable law. However, we disclaim all liability for any direct or indirect damages arising from unauthorized access to, or misuse of, your data.
4.4. You are responsible for maintaining the security of your devices, passwords, and login credentials. Meta Healthcare Pty Ltd will not be held liable for breaches caused by the End-User’s failure to secure their device or login information.
5.1. You agree to indemnify, defend, and hold harmless Meta Healthcare Pty Ltd, its directors, employees, and affiliates from any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of the App, breach of these Terms, violation of applicable laws, or infringement of third-party rights.
5.2. Meta Healthcare Pty Ltd shall not be liable for any claims arising out of your interaction with third-party service providers or healthcare providers accessed through the App.
6.1 General Limitation of Liability
Meta Healthcare Pty Ltd will not be held liable for any damages, losses, or costs arising from the use, misuse, or inability to use the Licensed Application, including but not limited to indirect, incidental, special, or consequential damages, lost profits, business interruption, or loss of information, even if Meta Healthcare Pty Ltd has been advised of the possibility of such damages.
6.2 No Liability for Third-Party Actions
Meta Healthcare Pty Ltd is not responsible for the actions of third-party service providers, third-party applications, or external platforms, including but not limited to the App Store, Play Store, or other third-party services that may interact with the Licensed Application. Any issues arising from interactions with such third-party services are the sole responsibility of the respective third-party provider.
6.3 Device and Network Liability
Meta Healthcare Pty Ltd is not responsible for any malfunction, damage, or loss resulting from the use of the Licensed Application on unsupported devices, outdated software, or compromised network environments. The End-User is responsible for ensuring that their device and network meet the Licensed Application’s technical requirements.
6.4 Limitation of Data Liability
Meta Healthcare Pty Ltd will not be liable for any unauthorized access, data breaches, or leaks resulting from circumstances beyond its control, including but not limited to hacking, malware, or attacks on third-party services such as the App Store, Play Store, or End-User devices. The End-User is responsible for maintaining the security of their own devices and passwords.
6.5 No Liability for User-Generated Content
Meta Healthcare Pty Ltd will not be liable for any content generated by users of the Licensed Application. Users are solely responsible for ensuring that their contributions comply with all applicable laws and third-party rights. Meta Healthcare Pty Ltd does not actively monitor user-generated content and will not be held liable for any legal claims arising from such content.
6.6 Service Downtime and Interruptions
Meta Healthcare Pty Ltd shall not be held liable for any service downtime, interruptions, or loss of functionality due to maintenance, system errors, or network issues beyond its control. The Licensor will make reasonable efforts to ensure the availability and functionality of the Licensed Application but does not guarantee uninterrupted access.
6.7 Healthcare Disclaimer
The Licensed Application is intended to facilitate communication and the management of healthcare services. It is not a substitute for professional medical advice, diagnosis, or treatment. Meta Healthcare Pty Ltd shall not be held liable for any medical decisions or actions taken based on information provided through the Licensed Application.
6.8 Limitation of Data Privacy Liability
Meta Healthcare Pty Ltd takes reasonable measures to protect the personal data of its users. However, Meta Healthcare Pty Ltd is not responsible for any breaches, leaks, or misuse of data due to the End-User’s failure to maintain the security of their device or login credentials, unauthorized access by third parties, or force majeure events, including cyberattacks. The End-User acknowledges that no system or application can be entirely secure, and Meta Healthcare Pty Ltd shall not be held liable for any data breaches beyond its control.
7.1. The App requires a minimum firmware version of [1.0.0] or higher. We recommend using the latest available version for optimal performance.
7.2. You are responsible for ensuring that your device meets the technical specifications required to run the App. Meta Healthcare Pty Ltd is not liable for performance issues arising from your use of outdated or unsupported software.
7.3. We attempt to ensure compatibility with the latest firmware and devices, but cannot guarantee that future updates will be supported on older versions or devices.
8.1. Meta Healthcare Pty Ltd is responsible for providing maintenance and support for the App.

8.3. We reserve the right to update the App at any time. However, we are not obligated to provide updates, and certain functionality may be limited or disabled without notice in the event of necessary maintenance or upgrades.

9.2. Your use of third-party services accessed through the App is subject to their respective terms and conditions. Meta Healthcare Pty Ltd disclaims all liability for issues arising from your interaction with third-party service providers.
10.1. Users may be allowed to submit content, such as profiles, comments, or reviews. By submitting content, you grant Meta Healthcare a non-exclusive, royalty-free, perpetual license to use, display, and modify your contributions for the operation of the App.
10.2. You agree that any contributions you make will not infringe third-party rights, violate any laws, or contain offensive or inappropriate material.
11.1. We may suspend or terminate your access to the App at any time, without prior notice or liability, if you breach any of these Terms or for any other reason at our sole discretion.
11.2. Upon termination, your right to use the App will cease immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect.
12.1. These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia.
12.2. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in New South Wales, or through the courts of New South Wales if arbitration is not available.
